1. Identification of the responsible party

2. Evaluator accounts, age and exam participation
To create an evaluator account and use EvaluatIA’s general tools, including the integrated artificial intelligence features for evaluators, you must be 18 years or older and accept these Terms and the Privacy Policy.
Evaluator registration requests age solely to verify this requirement. The exact age entered on the form is not retained as part of the profile; we record confirmation that the requirement of being 18 or older was met, together with the version of the accepted legal documents and the acceptance date.
Taking an assigned assessment is limited participant access and is not equivalent to creating or using an evaluator account. A participant may receive a code, link, student registration number or limited student identity to identify themselves and answer an exam. This access does not enable the evaluator dashboard, content creation or general tools reserved for registered users.
Participants under the age of majority may take assigned assessments when permitted by applicable rules and by the relevant institution, teacher, parent, guardian or representative. The evaluator or institution organizing the assessment is responsible for obtaining the authorizations required in their context.
3. Service description
EvaluatIA provides tools to create, edit, publish, administer, grade and manage educational assessments. Available features may vary, change or be suspended for technical, security, legal or product reasons.
4. Plans, prices, renewal and PayPal
EvaluatIA offers a free plan, a monthly subscription and paid credit packages. Before authorizing a transaction, the product, price, currency, frequency and corresponding credits are displayed. The monthly subscription currently costs US$3and provides 100 credits per paid cycle; the one-time payment package costs US$4and provides 120 credits. Future prices will be disclosed before purchase, and a change in a subscription’s price will require the applicable notice or consent.
PayPal is the payment provider. By proceeding, the user authorizes PayPal to process the charge and, for a subscription, recurring charges until cancellation. EvaluatIA does not receive or retain full card numbers, bank account details or PayPal credentials. PayPal may apply its own checks, terms, currency conversion or processing times.
The charge is expressed in US dollars. Before confirmation, PayPal may display the final amount, conversion, taxes or charges applicable to the payment method. EvaluatIA recognizes a purchase only when PayPal confirms the payment as completed.
5. Delivery and use of digital credits
A free account receives 20 monthly credits. Free renewal replenishes the monthly balance up to 20 without reducing previous balances. Each paid subscription cycle adds up to 100 credits, with a total accumulation limit of 300 for plan credits. Credits purchased separately are added in full, are not subject to that limit and are used after monthly credits.
Credits are delivered after payment confirmation and are linked to the account that made the transaction. They are not currency, electronic money or an investment; they earn no interest, cannot be transferred between accounts and cannot be exchanged for cash except where a refund is due under these Terms or a legal obligation. If payment was confirmed and credits do not appear, the user must contact support with the PayPal transaction identifier.
6. Subscription cancellation
The subscription can be canceled from EvaluatIA or, where available, from the PayPal account. Cancellation prevents future charges but does not by itself constitute a refund of the cycle already charged. Credits credited before cancellation are retained, and the plan remains paid until the end of the current period shown in the account.
To avoid renewal, cancellation must be completed before PayPal processes the next charge. If the charge has already been processed, a refund review may be requested under the following section. Account deletion does not replace cancellation of an active subscription.
7. Returns and refunds
For contracts entered into online, article 62 of Law No. 358-05 provides, among other guarantees, a minimum trial period of seven (7) business days before return of the goods or suspension of the service contract. Without prejudice to the interpretation of Pro Consumidor or a competent authority, EvaluatIA allows a refund request to be submitted for at least 7 business days from payment confirmation or availability of the credits, whichever occurs later.
The request must be sent to elio.diaz.cudeni@gmail.com from the account’s email address, stating the PayPal transaction identifier and the reason. Cases reviewed include duplicate or unauthorized charges, undelivered credits, uncorrected substantial failures, and purchases or renewals whose credits have not been used. Partial or total use will be considered when evaluating the solution, but will never remove non-waivable rights or prevent claims for a defective, insufficient or different service from what was offered.
EvaluatIA will review the complete request and communicate its decision within 3 to 5 working days. If approved, it will send the refund to PayPal within that same period and may withdraw or adjust credits linked to the refunded transaction. This is EvaluatIA’s handling period, not a guarantee of the final crediting date: PayPal, the bank or card issuer may need additional time and will normally return the money to the original payment method. Conversion differences applied by PayPal or the issuer may affect the amount shown in local currency.
This policy does not limit rights recognized by Law No. 358-05, a decision by Pro Consumidor, mandatory rules of the payment method issuer or applicable PayPal protections.
8. Disputes, chargebacks and abuse prevention
The user may first contact EvaluatIA to try to resolve the problem. They may also use PayPal’s Resolution Center or their bank’s mechanisms where applicable. They cannot obtain double recovery for the same transaction. A dispute, reversal or chargeback may cause credits linked to the transaction to be temporarily suspended while the case is verified, without preventing the exercise of legal rights.
PayPal Buyer Protection is a separate program and does not automatically apply to all transactions or digital goods. PayPal determines eligibility and deadlines under the agreements applicable to the user’s account. This EvaluatIA policy does not replace or reduce those mechanisms.
EvaluatIA may request reasonable information to verify identity, account ownership, the transaction and credit usage. Fraudulent requests, chargeback abuse or payment manipulation may lead to account restrictions and actions permitted by law.
9. Artificial intelligence and Google services
Some tools for evaluators use managed authentication, database and storage services, the Gemini API or other Google services. EvaluatIA’s integration is governed by Google’s contracts and terms applicable to the responsible party as a developer or customer of those services. Google operates its own services, and EvaluatIA does not control their changes, interruptions or decisions.
The portal used by a participant to open, answer and submit an assessment makes no direct calls to Gemini during that flow. Responses requiring review remain pending so that an authenticated evaluator can review them from the restricted evaluator area. AI features are limited to the areas and uses in which they can operate under the provider’s current terms and applicable rules.
When required by a permitted AI tool, content such as instructions, questions, files or educational context may be sent to the configured service to produce an output. The evaluator must not enter information they do not have the right to process or share for that purpose.
AI-generated outputs may contain errors. Evaluators are responsible for reviewing generated content and the results they use. EvaluatIA does not replace the teacher’s professional judgment or guarantee that an automated output is accurate or appropriate in every case.
10. Accounts and security
Registered users must provide truthful information, keep their credentials protected and use the account only for authorized purposes. They must notify us if they suspect unauthorized access. Limited participant credentials or identities must not be used to attempt access to tools reserved for evaluators.
11. Content, assessments and participant data
The evaluator retains their applicable rights over the content they add to the platform. By uploading or entering content, they declare that they have the necessary permissions to store it, process it and, when required by a permitted feature, transmit it to technology providers acting to provide the service.
The evaluator must minimize the personal data requested from participants and avoid sensitive data that is not strictly necessary. When inviting minors, they must configure the assessment and manage the institutional or representative authorizations required for the educational activity and under applicable law.
12. Prohibited use
It is prohibited to attempt to compromise the service’s security, access accounts or data without authorization, automate resource abuse, circumvent technical limits, infringe third-party rights, introduce malware, use the service for fraud or use it contrary to Dominican Republic law or the mandatory terms of integrated providers.
13. Availability, changes and suspension
We may perform maintenance, change features or suspend access when reasonably necessary for security, fraud, non-compliance, legal requirements or provider changes. We will seek to avoid unnecessary interruptions, but uninterrupted availability is not guaranteed.
14. Intellectual property
EvaluatIA’s brand, interface, code and proprietary elements are protected by applicable rules. These Terms do not transfer rights over those elements to the user, except for the limited right to use the service in accordance with these Terms.
15. Liability and consumer rights
EvaluatIA is provided as a supporting technology tool. Nothing in these Terms seeks to exclude non-waivable rights recognized by Dominican law, including the General Law for the Protection of Consumer or User Rights No. 358-05 where applicable. Any limitation of liability will be interpreted within the limits permitted by law.
16. Privacy and data protection
Personal data processing is described in the Privacy Policy, which distinguishes between registered user data and participant data. EvaluatIA primarily follows Law No. 172-13 on personal data protection in the Dominican Republic, without prejudice to other applicable rules.
17. Changes to these Terms
We may update these Terms to reflect legal, security, service or provider changes. When a change is material, a new version will be displayed and, where applicable, registered users will be asked for renewed acceptance before continuing to use affected features.
18. Applicable law and claims
These Terms are interpreted under the laws of the Dominican Republic. This does not limit a consumer’s right to approach Pro Consumidor, the competent courts or another relevant authority. Adhesion contracts will be handled in accordance with the applicable requirements of Law No. 358-05 and its implementing rules.
